I got caught with six cases of Chinese fireworks and I am charged with a felony. I was selling it out of my car's trunk, so they didn't even have to search for it. I'm sunk, right?
You never can tell what you'll find out just by making the prosecution prove their case. There was a similar case where the police had a large quantity of fireworks. Funny thing is: they couldn't store it in their super-secure evidence room because it is highly explosive, so they had it in a secluded shed. Well, the defense lawyer went to inspect the evidence and noticed that they had tons of fireworks and there were no partitions or dividers in the shed. All the evidence was mixed together. The judge suppressed the evidence when they could not prove which evidence was the defendant's fireworks, as they had neglected to mark each box. You don't win if you don't fight.
