On May 6, 2011, the 24/7 Sobriety Bill was enacted into law. Under the new law, offenders arrested for a second or subsequent DUI are required to submit to a breath test twice a day, seven days per week, to prove their sobriety from the time of their arrest to the completion of their sentence.

Montana Implied Consent Law/Test Refusal Consequences: Yes. Refusal to take an alcohol test can result in immediate license suspension for a year. Effective May 6, 2011, the governor signed into law Senate Bill 42 which makes it easier for law enforcement to get a warrant for blood tests on repeat offenders who refuse to submit to a breath test.
