Possession

FAQs

I share an apartment with three guys, but each of us have our own room. The cops had a warrant for one of my them and tossed the whole apartment. They found some pot and some coke and arrested all of us, but none of it was mine. I have no record but the police said we were guilty of "joint possession" because we were all on the lease. Should I take a deal?

I borrowed my friend’s car and got stopped by the police who asked if they could search. I said yes because I don't do anything illegal. They found some methamphetamine in the glove compartment, but it wasn’t mine. The cops said to "tell it to the judge." I guess I was "in possession" but I don’t feel like I committed any crime. Should I take the prosecutor’s offer for probation and no jail?

My buddy gave me a ride and the cops pulled him over. They found a balloon of heroin in the open ashtray and they charged both of us. Those were not my drugs. How can they do that?

I was arrested and charged with possession of marijuana while at a party. The judge suspended my license for six months. How can he do that when I wasn't driving?

I got stopped for a busted tail light and then, without my permission, the cop searched my car and found pot in the trunk. At the hearing, he said he knew I had drugs because he saw seeds on the floor and they were in "plain view", but the drugs in the trunk weren’t. Can a lawyer get the drugs excluded from evidence as illegally seized?

I was pulled over with some school friends because the police knew the driver was suspended. The police found a bag of marijuana on the floor and a burnt roach in the ashtray. They charged all of us with possession, but I wasn't using the marijuana and the bag on the floor wasn't mine. How can I be charged?

What does the term "unwitting possession" mean and is it a valid defense?

The police at a checkpoint found my city sticker was out of date. He ordered me out of the car and searched it. He found some drugs I had forgotten about in the trunk. Even though I objected to the search, I was charged with possession. The cop said he smelled marijuana and saw seeds on the floor while he was questioning me. Can he search the trunk of my car without my permission?

I got busted for possession of cocaine, but it was just dust residue, not enough to get a canary high. Can they do that?

I was driving a family car when I was stopped for DWI. When they arrested the car, found drugs under the front seat, and charged me with possession even though I told them I didn't know anything about the drugs. What was their basis for this?
