I was driving a family car when I was stopped for DWI. When they searched the car, they found drugs under the front seat and charged me with possession, even though I told them I didn't know anything about the drugs. What was their basis for this?
Actually they have very little basis in Virginia. The law specifically does not give rise to a presumption that the drugs found in a car belong to the driver/occupant or owner of the car. It is only "some evidence" of possession and can be rebutted by your testimony. That other individuals also operate the car gives credence to your defense.
