I got hurt in an accident and so did the other driver. I wasn't drinking but had codeine in me. I was released from the hospital but not arrested. I am worried they will arrest me for driving under the influence because the hospital drew blood. What can I do?
You should act promptly and hire a defense lawyer. He will not be able to stop them from charging you if the blood test shows the drugs, but he can make it easier for you if you see him early in the process. If you retain him and he notifies the police and prosecutor that he represents you, they will likely give him a courtesy notice when a warrant for your arrest issues. Then instead of the police arresting you, your lawyer just takes you to court and asks the judge to set bail. Procedures vary from state to state, but it is certainly worth seeing a lawyer to see if you can do this.
The alternative is to maybe get arrested at home or work on Friday afternoon and spend at least the weekend in jail. Just waiting passively is not only humiliating, but it is more expensive too. You are much more likely to receive a higher bail if you just wait to get arrested. By voluntarily surrendering, you take more control over the process and can have your bail bondsman ready with your bond as soon as you are booked, so that you spend zero time in jail while your case is pending.
