Implied Consent Law/Test Refusal Consequences: Yes - 1st offense: Refusal is admissible in court as evidence and license is suspended for 1 year; 2nd offense: Refusal is a 1st degree misdemeanor and license is suspended for 18 months. An officer will issue the driver a temporary permit effective 12 hours after issuance that is valid for 10 days if the driver is eligible.
