If I am arrested and put in juvenile hall, how long do I have to stay in custody?
The prosecutor’s office must file a petition with the court charging you with an offense(s) within at least forty-eight court hours after your arrest. Your first hearing must be the following day. Holidays and weekends do not count towards the time. Some states have different time guidelines so it is important to check locally. Whether you are then released to your parents is up to the judge and largely up to the probation officer, who is assigned to you when you are arrested. Juveniles do not have a right to bail.
