Can someone who is intoxicated commit larceny?
Yes. Voluntary intoxication is not a defense to the crime of larceny. However, if a person is so intoxicated that he cannot even understand that he is in the act of permanently depriving the victim of his property, then that element of specific intent could be lacking and therefore, the defendant may be found not guilty. Most intoxicated people could not establish that defense, however.
